6. Alan is Evicted from his Home of 10 Years – by his Longtime Roommate Peter Stokes and the Landlord with Fidelity Property Management/CVS Management…and is Escorted out of his Home by the Peel Regional Police

After living in his apartment of 10 years at 150 Lakeshore Road East in Port Credit, Mississauga, Alan was forced to abandon his home and was forced out by his long time roommate Peter Stokes. When Alan first moved into his apartment unit managed by Fidelity Property Management/CVS Management, Alan jointly took possession of the apartment unit as an equal co-tenant, and he believed he entered into a joint tenancy agreement with his roommate Peter Stokes and in agreement with Fidelity Property Management/CVS Management, for rental of a 3 bedroom apartment. 

1. Lease Agreement for Equal Co-Tenancy and Occupancy 

Alan always trusted and relied on Peter Stokes to prepare the lease agreement and assumed that Peter Stokes had listed both himself and Alan as equal joint co-tenants. At all times and for the entire 10 year tenancy, Alan assumed that this was in place and which was the foundation of Alan and Peter’s legal status defined as joint tenants. However Alan never received any copies of the executed lease agreements and trusted Peter Stokes to ensure that he was listed with status as an equal co-tenant, and fully defined and demonstrated on the lease agreement with Fidelity Property Management/CVS Management. 

In fact, Alan had paid rents with 120 consecutive payments and without ever missing a monthly rental payment. In addition, Alan paid for the majority of all food costs which Peter was supposed to reimburse Alan but never did, as they were sharing all food costs. 

2. Alan Demands Full Disclosure of All Monies Paid over 10 Years to Peter Stokes 

With the engagement and intervention of Alan’s legal and financial advisor with Gerry Jutsun, Alan asked Peter for all legal and financial documents including the purported lease agreement with Fidelity Property Management/CVS Management. Additionally Alan requested an accounting of all monies that Alan gave to Peter for the rents and utility charges over the 10 years that they lived together. There was also the issue of food costs which Alan was to be reimbursed for, but never received. 

The quantum of monies that Alan gave to Peter was in excess of $100,000 and Peter only took all monies in cash, but never provided any receipts or acknowledgement of the monies he took from Alan. Now the time had come for Peter to produce a full accounting of the $100,000+ dollars that Alan had fully paid over the 10 year tenancy for all rents, utility bills and unreimbursed food costs. With the engagement of Gerry Jutsun, President of Jutsun & Company Law Associates, Alan and Gerry determined that Peter had been overpaid and expropriated excess monies in the amount of $24,000

On Saturday August 10, 2019 Alan Russell wrote to Peter Stokes requesting a full accounting of all monies he had paid Peter, as well as demanding $24,000 in overpayments. To compound matters Alan also requested proof from Peter that the landlord with Fidelity Property Management/CVS Management, had actually increased the rent by $188.00 per month right after Alan’s stroke in August 2018 

With a written request, Peter Stokes never responded to Alan’s formal letter, and never provided any proof of disbursements with receipts, invoices, the lease agreement and proof that substantiated the rental increase in August 2018. 

To date Alan is awaiting full disclosure and all relevant documentation to validate Peter Stokes prejudicial actions. The abject failure of Peter Stokes to act in good faith and provide full disclosure with all particulars, is the motivation and crystallization of legal redress against Peter Stokes and will commence in 2021. 

3. Peter Stokes Has Possession of Unregistered Firearms and Live Ammunition 

Unbeknown to most residents of 150 Lakeshore Road East, the apartment at #604 shared by Alan Russell and Peter Stokes has unregistered firearms with “hunting rifles” and “live ammunition” owned by Peter Stokes. It is unclear if these are licensed and registered firearms and whether the ammunition is properly and securely stored and contained, complying with all prevailing safety and building fire codes. 

Alan has always lived in fear of Peter due to his unwieldy and mercurial temperament, and where Alan was always afraid that Peter might shoot Alan if he was enraged and took out his anger on Alan. With the revelation of these deadly firearms, Alan informs his legal assign with Gerry Jutsun, President of FSI Fraud Security Investigations, and Gerry writes an urgent and emphatic letter to Jim lles, the property manager at Fidelity Property Management/CVS Management; that there appears to be unregistered and unlicensed firearms with 2 rifles and rounds of live ammunition. 

Surprisingly Jim Iles is nonplussed and ignores the disclosure of deadly weapons in the hands of an emotionally unstable and enraged individual. Apparently Fidelity Property Management/CVS Management has no prevailing rules or regulations for the permission and safe storage of registered firearms and live ammunition. 

On Friday May 31, 2019, Gerry Jutsun does attend the Superior Court of Justice of Ontario at the Brampton Courthouse and advises the presiding Justice of the Peace, that Peter Stokes is in possession of lethal firearms and ammunition and which may not be properly registered and licensed, as well as not being in compliance with safety protocols and requirements for storing firearms and live ammunition, in accordance with all prevailing statutes and building codes. 

On the following Saturday June 1, 2019, the Peel Regional Police attended Peter Stokes apartment at #604 and searched for the 2 hunting rifles and all live rounds of ammunition. At this point, Alan is further terrified and fearful for his life, because he believes that Peter will single him out for disclosing his weapons and ammunition, and is taken to Trillium Hospital Emergency for suicidal ideation and depression, now fully expecting that Peter Stokes will look to kill Alan Russell. 

It is unclear what the Peel Regional Police found and where Peter Stokes’ rifles and live ammunition are currently stored.
